2. These terms

These terms apply to all orders placed through this website. Please read them before ordering. By placing an order you agree to them. If you are a consumer, nothing in these terms affects your statutory rights.

3. Placing an order and forming a contract

After you place an order, you'll receive an email acknowledging it. This acknowledgement is not an acceptance of your order. The contract between us is formed when we email you to confirm that your order has been dispatched.

We may decline an order for any of these reasons:

  • the item is out of stock
  • there is an obvious pricing error
  • we can't deliver to your address
  • we suspect fraud

If we decline your order after taking payment, we'll refund you in full.

4. Prices and payment

Prices are shown in pounds sterling. Prices for UK customers include VAT. Prices for EU customers do not include UK VAT, and do not include EU import VAT, customs duty or carrier fees, which are payable by the customer on delivery. See our Delivery Policy for details. Delivery charges are shown at checkout.

If we discover an obvious error in a price, we'll contact you before dispatch. You can then confirm the order at the correct price or cancel it for a full refund.

Payment is taken at checkout through Shopify's secure payment providers. We never see or store your full card details.

5. Delivery

Delivery options, charges and dispatch times are set out in our Delivery Policy.

Risk in the goods passes to you when they're delivered to you or to someone you nominate. Ownership passes to you once we've received full payment.

For deliveries outside the UK, you are the importer. You are responsible for any import duties, taxes or customs charges in your country.

6. Cancellations, returns and refunds

Your right to cancel, and how returns and refunds work, are set out in our Returns & Refunds Policy.

7. Faulty goods and our lifetime warranty

We're under a legal duty to supply goods that are of satisfactory quality, fit for purpose and as described. Your rights if something is faulty are set out in our Returns & Refunds Policy.

In addition to your statutory rights, Moto Cinch products come with a lifetime warranty against defects in materials and workmanship, for as long as the original purchaser owns the product. If a product develops a defect covered by this warranty, we'll repair or replace it free of charge.

The warranty does not cover:

  • misuse, abuse or accidental damage
  • incorrect fitting or use not in line with the instructions supplied
  • modification or repair by anyone other than us
  • normal wear and tear
  • use with equipment the product isn't designed for

To make a warranty claim, email eb@motocinch.com with your order number, a description of the problem and photos. Please contact us before sending anything back.

8. Using our products safely

Moto Cinch products must be fitted and used in line with the instructions supplied. Before and during transport, check that your motorcycle is secure and that the product is correctly fitted and undamaged. Do not use a product that shows signs of wear or damage.

We are not responsible for loss or damage caused by any of the following:

  • incorrect fitting
  • misuse
  • modification of the product
  • use with equipment it isn't designed for
  • failure to follow the instructions

9. Our liability

If we fail to comply with these terms, we're responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence.

Nothing in these terms limits or excludes our liability for any of the following:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • breach of your legal rights as a consumer, including your rights under the Consumer Rights Act 2015 and equivalent EU laws

We supply products for domestic and private use. If you use them for commercial or business purposes, we are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.

10. Website content and intellectual property

All content on this website is owned by or licensed to us and Moto Cinch. This includes text, images, logos and videos. You may not copy or reuse it without our permission.

We try to keep product information accurate. However, product images are for illustration, and packaging may vary.

11. Your personal information

We use your personal information only as set out in our Privacy Policy.

12. Events outside our control

We're not responsible for delays or failure to perform caused by events outside our reasonable control, such as carrier disruption, strikes or severe weather. If this happens, we'll contact you as soon as possible. If a delay is significant, you may cancel for a refund of anything you've paid for goods not received.

13. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one on this website when you placed it.

14. Governing law and disputes

These terms are governed by the law of England and Wales.

  • UK customers: You can bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can bring them in your local courts.
  • EU customers: You keep the protection of the mandatory consumer laws of your country of residence, and you can bring proceedings in your local courts.
